What to review before signing a lease

A practical guide to parties, payments, handover conditions and supporting documents in a residential or commercial lease.

Identify the property and the parties

Check that the address, unit and permitted use match the property you visited. Record whether parking, storage or shared facilities are included. Clarify who will sign and whether that person represents a company or another individual. Documents establishing authority may need to be reviewed with the agreement.

List every payment separately

Set out rent, payment dates, bank details, service charges and other costs in separate entries. Distinguish the security payment from advance rent. Record the period each payment covers. Residential, roofed commercial and other leases should not be treated as interchangeable. Questions about increases or termination require the agreement, the type of relationship and applicable rules to be considered together.

Plan the handover

Discuss a joint record of the condition of the property, meters and fixtures. Keep dated notes about visible defects and preserve original photographs with room descriptions. If renovations were discussed, clarify who arranges the work, how costs are allocated and which permissions may be needed.

Read the complete agreement

Collect fixture lists, building rules and every referenced attachment. Mark blanks and differences between versions. The signature page alone is not enough for review. The Turkish Code of Obligations provides the legal framework for leases; this preparation guide does not establish the validity of an individual clause.

Before your consultation

  • Every page and attachment of the lease
  • Separate rent, security and cost entries
  • Handover date, fixtures and condition notes

Frequently asked questions

Can one template fit every lease?

Do not assume a standard document suits your relationship. Intended use, parties, duration and specific terms require review.

How should I record verbal discussions?

Note the subject, date and participants. Preserve existing messages in their original form so the discussion can be considered alongside the agreement.
